1. Introduction & Consent to Terms
Welcome to Southern Utah Cleaning Company, LLC, a Utah limited liability company (“Southern Utah Cleaning Company,” “we,” “us,” or “our”). These Terms of Service (“Terms”) set forth the terms and obligations between us and you, our client.
Thank you for choosing Southern Utah Cleaning Company for your cleaning, repair, or landscaping needs. By using our home cleaning, repair, or landscaping services (“Services”), you explicitly accept these Terms.
2. Exploring Our Services & Initial Consultation
If you think Southern Utah Cleaning Company might be a good fit for your needs, please contact us to receive a quote for your proposed job(s). All quotes are estimates only and are based on the estimated scope of work.
Sometimes jobs end up being larger than represented to us or something outside our control may cause the quote to increase. Before charging you any increase, we will notify you in writing and you must accept the increase before we move forward.
3. Performance of Services
Southern Utah Cleaning Company agrees to perform the Services listed on your quote. If one or more services you need are not listed on your quote, it is your responsibility to ensure all necessary work is included.
All work will be done by one or more of our agents. When you hire Southern Utah Cleaning Company, you are hiring the company and not any individual employee, agent, or worker.
All times provided for the Services are estimates only. While we do our best to arrive on time, we cannot guarantee an exact time of arrival or departure. We reserve the right to change the person or persons handling the Services for you.
You agree to provide access to your home or other service location. Any inability to perform Services due to lack of access will be borne solely by you.
We recommend, but do not require, that you are home before and after our Services are finished so you can review the work. If you are not home at the conclusion of our Services, the Services will be deemed completed and accepted by you upon our exit.
4. Terms of Purchase
Quotes are provided free of charge and expire after thirty (30) days.
- Flat Fee Services: Offered at a flat rate based on the nature of the work, time required, number of workers, and other factors in our sole discretion.
- Hourly Services: Offered based on time spent working on your Services. Time is billed in fifteen (15) minute increments.
- Recurring Cleaning Services: Weekly or monthly recurring services that automatically renew until canceled according to these Terms.
5. Deposit
If required, you agree to pay an initial deposit to reserve Southern Utah Cleaning Company for selected dates, timeframes, or otherwise. Deposit amounts are determined by Southern Utah Cleaning Company based on anticipated work, scope, and difficulty.
If a deposit is required, your booking is not reserved until the deposit is paid. Subject to the cancellation section below, deposits are non-refundable and applied to the total balance owed.
6. Payment, Billing, and Other Terms
All prices are in U.S. Dollars. We accept most forms of payment. A four percent (4%) processing fee may apply to certain payment methods.
We reserve the right to change our Services or Recurring Cleaning Service at any time, including cost. If we change the amounts or other charges associated with your Services, we will provide thirty (30) days advance written notice where applicable.
By providing payment information, you represent that it is accurate, that you are authorized to use the payment method, and that you will notify us of any changes. We may use third-party payment card updating services to obtain current expiration dates on credit and debit cards.
By providing a credit card, you authorize us to charge your payment method for all charges related to your Services. If your payment is denied, you will be responsible for an administrative fee of fifty dollars ($50.00).
If you are enrolled in Recurring Cleaning Service, you acknowledge that Southern Utah Cleaning Company or its third-party payment processor is authorized to charge you on a monthly or other basis for as long as your recurring service continues.
All invoices are due and payable within forty-eight (48) hours of receipt. Failure to pay on time may result in interest at three percent (3%) per month, and accounts more than thirty (30) days past due may be transferred to a collection agency or attorney. We may recover all reasonable collection costs and attorneys’ fees.
7. Warranties of Services Performed
- The Services will be performed in a professional manner, consistent with or exceeding industry standards.
- Southern Utah Cleaning Company has industry standard liability insurance covering issues that may arise from performance of the Services.
8. Cancellation, Refunds, and Our Satisfaction Guarantee
All cancellations or date changes must be made within twenty-four (24) hours of your scheduled start time. If you cancel within twenty-four (24) hours, we are entitled to keep your deposit. In some cases, the deposit may be applied to a future booking, but refunds are at our sole discretion.
You may cancel your Recurring Cleaning Service at any time by emailing us at info@southernutahcleaningcompanyllc.com.
Our Satisfaction Guarantee
We offer a satisfaction guarantee for all jobs we service. If your job was not done to your satisfaction and if we are unable to re-do the work to your satisfaction, we will offer you a refund of all monies paid, subject to the terms below:
- You must give us a chance to re-do the job before a refund is available.
- If you remain dissatisfied after we have had a chance to re-do the work, we will refund all monies paid within seventy-two (72) hours of your written notice of continued dissatisfaction.
- If you do not give us a chance to re-do the work, you are not entitled to a refund.
9. Workplace Protections
Ensuring that our workers are safe while performing the Services is extremely important to us. We do not permit the following work to be done:
- Cleaning beyond what is reachable on a three-step ladder
- Cleaning of biohazard substances
- Cleaning of areas infested with insects or other animals (not pets)
- Cleaning areas with mold or other toxins
- Any other task that could jeopardize the health, wellness, or safety of our workers
10. Limitations of Engagement
While we promise a high standard of quality, there are limitations to our engagement.
- Pets: It is your responsibility to ensure pets are cared for. We do not assume liability for the health and safety of your pets outside of gross negligence.
- Personal Property: It is your responsibility to ensure your belongings can be cleaned with our products and that valuables are removed or pointed out. We do not assume liability for damage to items that were not properly disclosed.
- Fixtures and Décor: It is your responsibility to ensure fixtures and home décor are in good working order. We do not assume liability for damage resulting from pre-existing weakness or poor condition.
11. Reviews
If you are happy with our Services, we encourage you to leave a review on an online platform of your choosing. If you leave a negative review, please ensure it is truthful. We reserve the right to pursue damages, including attorneys’ fees, for untruthful reviews that harm our business.
12. No Solicitation of Workers
By hiring Southern Utah Cleaning Company, you agree not to solicit or encourage any person employed by Southern Utah Cleaning Company to work with you directly or indirectly outside of the company.
If you breach this section, you agree to pay liquidated damages in the amount of one thousand dollars ($1,000.00) per violation, in addition to any other remedies available to Southern Utah Cleaning Company.
13. Photographs for Promotional Purposes
By using Southern Utah Cleaning Company for the Services, you permit us to take photographs of the work performed for marketing, advertising, and promotional purposes, including on our website and social media accounts. This includes before and after photos.
14. Intellectual Property
The contents of our website are protected by United States and international copyright laws and are owned exclusively by Southern Utah Cleaning Company or licensed to us. You may not reproduce, distribute, display, sell, transfer, assign, license, or use our intellectual property for commercial purposes without prior written consent.
15. Disclaimer
OUR SERVICES ARE PROVIDED “AS IS” AND, TO THE EXTENT PERMITTED BY APPLICABLE LAW, SOUTHERN UTAH CLEANING COMPANY AND ITS DIRECTORS, OFFICERS, EMPLOYEES, AGENTS, AND REPRESENTATIVES EXCLUDE ALL REPRESENTATIONS OR WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED.
WE EXPRESSLY DISCLAIM ANY LIABILITY FOR LOSS OR DAMAGE SUSTAINED BY YOU AS A RESULT OF USE OF OUR SERVICES.
16. Limitation of Liability
Southern Utah Cleaning Company shall not be liable for delay or failure in performance for causes beyond our control or for indirect, incidental, special, or consequential damages.
IN NO EVENT SHALL OUR TOTAL LIABILITY TO YOU EXCEED THE TOTAL AMOUNT YOU PAID SOUTHERN UTAH CLEANING COMPANY FOR THE SERVICES.
No claims or actions arising out of or related to the use of our Services or these Terms may be brought more than one (1) year after the cause of action arose.
17. Indemnification
Each party shall indemnify, defend, and hold harmless the other and their directors, officers, owners, managers, employees, and agents from and against losses, damages, liabilities, reasonable attorneys’ fees, court costs, and expenses arising from use of the Services, breach of these Terms, or applicable law.
18. General Provisions
- Entire Agreement: These Terms contain the entire agreement between you and Southern Utah Cleaning Company except for inclusions found within a quote.
- Waiver: Failure to enforce any provision is not a waiver of our right to later enforce strict compliance.
- Assignment: You may not assign or transfer your rights or obligations without prior written consent.
- Relationship: Nothing in these Terms creates an agency, employment, franchise, joint venture, or partnership relationship between you and Southern Utah Cleaning Company.
- Applicable Law / Dispute Resolution: These Terms are governed by the laws of the State of Utah. Except for non-payment by you or an untruthful review, all disputes arising from or in connection with this Agreement are subject to binding arbitration. The prevailing party may recover reasonable attorneys’ fees and costs.
- Severability: If any provision is held invalid or unenforceable, the remaining provisions continue in effect.
